Terms of Service

These Terms are an agreement between you and Storyboarder, Inc. (“Talebreak,” “we,” “us,” or “our”). By selecting a control that says you agree, creating or using an account or guest identity, or otherwise using the Service after these Terms are presented, you agree to them. Our Privacy Policy explains how we handle personal information. If you do not agree, do not use Talebreak.

1. Who may use Talebreak

You must be at least 13 years old to use Talebreak. If you are under the age at which you can enter into these Terms where you live, a parent or legal guardian must review and agree to them for you. You must not use the Service if applicable law bars you from doing so.

2. Accounts, guests, and invitations

Some features require an account. Others may permit guest use or require an invitation, waitlist admission, or other approval. Keep your sign-in method secure and provide accurate information. You are responsible for activity through your account or guest identity to the extent permitted by law. Invitations and access permissions may not be sold or transferred.

3. The Service

Talebreak is a multiplayer creative world for making Characters, meeting other people's Characters, playing, building, talking, and creating stories together. Features may change during testing. We may add, modify, suspend, or discontinue features, subject to applicable law. Talebreak is not an archival service, so keep your own copies of creative work you cannot afford to lose.

4. Your content remains yours

“User Content” means Characters, artwork, images, writing, messages, conversations, Worlds, photos, dialogue, and other material you submit to or create through Talebreak. As between you and Talebreak, you retain the rights you have in your User Content. We do not take ownership of your Characters or creative work.

You represent that you have the rights needed to submit User Content and allow the uses described in these Terms. You may not submit material that violates law, another person's rights, or the community rules below.

5. Permission to operate Talebreak

You grant Storyboarder, Inc. a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, perform, transmit, and technically modify your User Content only as reasonably needed to:

  • Provide the features and audience choices you select.
  • Let Characters and creations appear and function in shared Worlds.
  • Create technical formats such as cutouts, resized images, textures, thumbnails, and replay assets.
  • Operate authorized Theater recording and playback.
  • Secure, back up, maintain, and troubleshoot the Service.
  • Review, restrict, preserve, or remove content under these Terms and applicable law.

6. Duration and promotion

The license above lasts while the content is hosted or needed to provide the Service, plus a reasonable period for backups, legal compliance, disputes, deletion processing, and shared records that another participant controls. It does not give Talebreak ownership of your User Content. We will not use your artwork in off-service advertising or promotional features without separate permission.

7. Shared stories and other people’s Characters

Conversations, events, photos, Worlds, and stories may include contributions from several people. You keep the rights you have in your contribution, but you do not gain ownership of another person's Character, artwork, or contribution merely because your Characters interacted. Other participants may retain their own records of a shared interaction. Do not present another person's Character or contribution as your own or commercially exploit it without permission.

8. Technical image processing

Talebreak may technically process uploaded art to create game-ready cutouts, sizes, textures, and other assets. This processing does not transfer ownership of the original art. You are responsible for reviewing the result, which may be inaccurate.

9. Theater recording

Some multiplayer Worlds have Theater recording enabled. Talebreak displays a recording indicator in compatible clients. Recording may include movement, actions, Character appearance, public chat, eligible conversation lines, participation times, and World state. By remaining in and participating in a recording-enabled World after receiving notice, you agree to the recording and playback described in the Service and Privacy Policy. If you do not want to be recorded, leave that World.

10. Community rules

Use content warnings and audience controls where Talebreak provides them. You may not:

  • Harass, threaten, stalk, exploit, groom, or abuse another person.
  • Promote real-world violence or hatred, or target people based on a protected characteristic.
  • Submit sexual exploitation or non-consensual sexual content, including sexual content involving minors.
  • Dox, deceptively impersonate, scam, defraud, or expose another person's private information.
  • Encourage self-harm or suicide, or make a credible threat of harm.
  • Infringe copyright, trademark, privacy, publicity, or other rights.
  • Distribute malware, evade access or safety controls, cheat, or attempt unauthorized access.
  • Scrape, harvest, reverse engineer, or automate access except as permitted by law or written authorization.
  • Use Talebreak for unlawful activity.

11. Moderation and enforcement

We may investigate content or conduct and may warn people; limit features; hide, remove, or preserve content; restrict Worlds; suspend or terminate access; or report conduct to authorities when reasonably necessary to enforce these Terms, protect people or Talebreak, or comply with law. We may make mistakes; contact support@storyboarder.com to ask us to review a decision.

12. Copyright

We respect intellectual-property rights and may remove material we reasonably believe infringes them. If you believe material on Talebreak infringes your copyright, send a notice identifying the work, the material and its location, your contact information, your good-faith belief, a statement made under penalty of perjury that the notice is accurate and you are authorized to act, and your physical or electronic signature to support@storyboarder.com. We may terminate repeat infringers in appropriate circumstances.

13. Talebreak materials and feedback

Except for User Content, Talebreak and its software, designs, artwork, branding, text, audio, and other materials are owned by Storyboarder, Inc. or its licensors and are protected by law. We give you a limited, personal, non-exclusive, non-transferable, revocable permission to use the Service for its intended purpose.

If you voluntarily give us product feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use that feedback without restriction or compensation. This covers ideas about Talebreak, not your Characters, artwork, or private communications.

14. Third-party services and payments

Talebreak may use or link to third-party sign-in, hosting, storage, and technical services. Their services may have separate terms and privacy policies. Talebreak currently does not offer paid purchases or creator monetization. Future paid or monetization programs may have additional terms presented before participation.

15. Leaving, deletion, and termination

You may stop using Talebreak at any time and may permanently delete your account from Settings. Deletion is subject to the Privacy Policy, shared-content rules, reasonable backups, security and legal records, and minimal retired Character records needed to preserve another person's collection or shared history.

We may suspend or terminate access if you materially or repeatedly violate these Terms, create risk or harm, or if we discontinue the Service. Where practical and safe, we will provide notice and an opportunity to ask for review. Provisions that by their nature should survive termination will survive.

16. Disclaimers and limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT USER CONTENT WILL NEVER BE LOST.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STORYBOARDER, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES. OUR TOTAL LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US DURING THE 12 MONTHS BEFORE THE CLAIM OR US $100. THESE LIMITS DO NOT APPLY WHERE LIABILITY CANNOT LAWFULLY BE LIMITED.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Storyboarder, Inc. and its affiliates from claims arising from your unlawful use of the Service, your violation of these Terms, or User Content that infringes another person's rights.

18. Governing law

These Terms are governed by the laws of Delaware, USA, without regard to conflict-of-laws principles, except to the extent the law where you live requires otherwise.

19. Changes, miscellaneous terms, and contact

We may update these Terms as Talebreak changes. We will update the date above and provide additional notice when required. If any provision is unenforceable, the remaining provisions remain in effect. A waiver must be in writing and does not waive a later breach. You may not assign these Terms without our consent; we may assign them as part of a merger, reorganization, financing, or sale of the business.
